Right of appeal to Land Appeal Court

A party to a proceeding in the Land Court may appeal to the Land Appeal Court against all or part of the decision of the Land Court.

Notice of appeal

A party intending to appeal against a decision of the Land Court must, within 42 days after the court's decision is given to the party, serve notice of appeal against the decision on:

  1. all other parties to the proceeding on which the decision was made; and
  2. the registrar of the Land Appeal Court.

The notice of appeal must state the grounds on which the decision is appealed against.

A fee is payable upon filing an appeal (form 2) in the Land Appeal Court (see Fees and Charges).
